1. INTRODUCTION

In compliance with Law 34/2002 of July 11 on Information Society Services and Electronic Commerce, EU Regulation 2016/679 on Data Protection, Royal Legislative Decree 1/2007 of November 16 approving the revised text of the General Law for the Protection of Consumers and Users, and other applicable regulations, BEATERS has drafted these Purchase Conditions for the contracting process of the items offered on the website www.beatersshoes.com

This document (hereinafter the “Conditions”) constitutes a commercial agreement between the User (hereinafter the “Client” or “User”) and ANGELS PEREZ OLANO (hereinafter “BEATERS”). These Conditions establish the rights and obligations of both the Client and BEATERS and expressly, clearly, comprehensibly, and unequivocally set out the identity of the Website owner, the characteristics of BEATERS items, prices, methods of payment, purchase process, warranties, returns, and any other circumstances relating to the purchase of BEATERS items.

All BEATERS items offered on the Website are sold directly by ANGELS PEREZ OLANO (hereinafter, BEATERS), domiciled at Calle Muntaner 502, 2-4, 08022 Barcelona (Spain), with NIF 46150099R, and holder of the BEATERS trademark.

By placing an order, the Client expressly accepts these Conditions, as well as the Privacy Policy and Legal Notice available on the Website www.beatersshoes.com

. If the Client does not agree with them, they must not register, browse the Website, or place any order. BEATERS may modify these Conditions at any time and without prior notice; therefore, the Client must read them before placing each order, as the Conditions in force at the time of placing the order shall be binding.

Through its Website, BEATERS offers BEATERS items 24 hours a day, every day of the year. Minors are not permitted to place orders.

2. REGISTRATION ON THE WEBSITE

The User is not required to register as a Client, but must provide the necessary personal data for shipping and, where applicable, invoicing, such as full name, address, and phone number.

Failure to provide, or inaccuracy of, personal data will prevent registration as a registered Client or guest on the Website. All personal data provided shall be subject to our Privacy Policy.

Before completing registration, whether as a registered Client or guest, the User must accept these Purchase Conditions.

3. CLIENT OBLIGATIONS

The Client undertakes to:

Provide BEATERS with true and accurate personal data necessary for the delivery of orders.

Pay for the BEATERS items purchased through the Website and any applicable shipping costs.

Not place fraudulent or false orders. BEATERS reserves the right to cancel the order and/or inform the relevant authorities if it has reasonable grounds to consider it as such.

Refrain from carrying out any activity that hinders or interferes with the functioning of the Website.

4. DELIVERY TERRITORY

BEATERS items are delivered exclusively in the countries where our Website is available. Each country has its own Website with specific items, prices, and shipping costs that may vary. The system will automatically recognize the country of access.

5. PURCHASE PROCEDURE

The Client must access the Website to purchase BEATERS items, with the following information available:

  • Description of the item, reference, size, features, colors, composition, and photo
  • Unit price
  • Shipping costs
  • Validity conditions of the offer, if applicable

Once the item has been chosen, the Client must add it to the cart by clicking on the “ADD TO CART” button, selecting the desired quantity, size, color, etc. Once the items have been added to the cart, the Client may access a summary by clicking the cart icon at the top right of the page, where the selected items will be displayed. If the Client wishes to modify quantities, remove items, or complete the purchase, they must click “VIEW CART” on the right side of the page, where the following information will be detailed:

  • Product
  • Description
  • Unit price
  • Quantity
  • Total price per item
  • Total purchase price

To finalize the purchase, the Client must select the “CHECKOUT” button within the cart and proceed to “CUSTOMER INFORMATION,” where they must enter their email address and shipping details. The Client may opt in to receive news and special promotions. In such a case, only their email address will be stored for this purpose, always related to promotions concerning the purchased product. Additionally, the Client can review and edit shipping and billing details. They may also choose to save their information for future purchases. This information will not be used for any other purpose or stored by the company, except to facilitate autofill for future orders.

If the Client has a promotional code or online voucher, it must be applied at this stage.

Next, the Client will proceed to the “SHIPPING” tab, where they will see a summary of their contact and shipping details, as well as the final price including shipping options and costs. Afterwards, the Client will select the method of payment from the available options and enter the requested data.

To confirm the purchase, the Client must accept the Purchase Conditions by checking the corresponding box and proceed by clicking on the “I HAVE READ AND ACCEPT THE TERMS AND CONDITIONS” box, followed by the “COMPLETE ORDER” button. The Client will then receive an email with their order details (“Order Confirmation”). Failure to receive this message may be due to temporary communication issues on the network or a typographical error in the provided email address. 6. CURRENCY, PAYMENT METHOD, AND APPLICABLE TAXES

Prices are displayed in euros. In accordance with current legislation, all purchases made through the Website are subject to applicable taxes. For security reasons, the Client cannot place orders exceeding €2,000 or containing more than 15 items within a fifteen (15) business day period. BEATERS makes every effort to ensure that the information on its Website is accurate and error-free. If any error occurs, it will be corrected immediately.

BEATERS reserves the right to modify prices displayed on the Website without prior notice; however, such changes will not affect the price of orders already placed.

BEATERS accepts payments by credit or debit card (Visa, Visa Electron, Mastercard, Maestro, American Express, Diners). Pursuant to Article 37 of Law 16/2009 of November 13 on payment services, payment authorization by card is irrevocable. By providing card information, the Client authorizes the charge to their card.

All payments are processed through a secure payment gateway that encrypts card data. To ensure maximum payment security, BEATERS uses secure payment systems from leading e-commerce financial institutions. Confidential payment data is transmitted directly and encrypted (SSL) to the relevant financial institution. For Visa and Mastercard payments, BEATERS uses the international 3D Secure protocol (Verified by Visa and MasterCard SecureCode). During payment, the system will automatically verify whether the credit card is enabled for Secure E-commerce. It will then connect with the issuing bank, which will request personal authentication to authorize the transaction. The operation will only be completed if the issuing bank confirms the authentication code; otherwise, the transaction will be rejected.

As an additional anti-fraud measure, BEATERS reserves the right to verify personal data provided by the Client and take any measures deemed appropriate (including order cancellation) to ensure that purchased goods are delivered in accordance with the order details.

7. SHIPPING AND DELIVERY OF ITEMS

Items are sold and delivered only in the countries where BEATERS operates. The delivery country must always match the country website from which the Client placed the order.

Once the order leaves BEATERS’ warehouses, the Client will receive an email notifying them that the order has been shipped.

Orders will be delivered to the shipping address provided by the Client at the time of placing the order. It is therefore important that the Client ensures the accuracy of the address, as it cannot be modified once the order has been placed. BEATERS will not be responsible if the delivery address is incorrect or incomplete.

For security reasons, BEATERS will not ship any order to P.O. boxes, nor will it accept any order if it is not possible to identify the recipient and their address.

BEATERS is not responsible for damage that may occur to the product or its packaging during transport. In such cases, responsibility lies with the transport company.

Once the order has left BEATERS’ warehouses, responsibility for potential delivery delays falls on the courier company, and BEATERS shall not be liable for such delays.

Responsibility for BEATERS items passes to the Client at the time of delivery.

8. DELIVERY ISSUES

If the delivery period indicated in the Shipping section has passed without the Client receiving their order, they must notify BEATERS of this circumstance.

When the order is delivered, the Client must check that everything matches their request. If there is any discrepancy or issue, they must notify BEATERS at hello@beatersshoes.com

, specifying their personal data, order number, and details of the issue. BEATERS will contact the Client as soon as possible to resolve the matter.

9. RETURNS

Right of withdrawal:

The User has a maximum period of 15 calendar days to exercise their right of withdrawal, in accordance with applicable legislation. After this period, BEATERS does not accept returns under the right of withdrawal.

The User must bear the cost of returns made under this right. To do so, the User must (i) notify BEATERS of their intention to withdraw before the 15-day deadline from delivery.

Once the product is received, BEATERS will verify its condition and process the refund in accordance with applicable Spanish law.

Refund for the User:

In the event of withdrawal, the User is entitled to a refund of the price of the returned products, provided they are in the same condition as delivered, unused (other than necessary to assess suitability), unwashed, undamaged, and otherwise compliant with applicable law and these Conditions.

BEATERS will not issue a refund until the product is received and its condition verified. BEATERS reserves the right to deny the refund if the returned products do not match the original purchase or if the return was not carried out in accordance with applicable law and these Conditions.

BEATERS will process the refund via the same payment method used by the User within 48 hours of confirming receipt of the returned product, and in any case, no later than 14 calendar days from the User’s notification of withdrawal, unless BEATERS has not received the product within that period. The refund will be applied to the User’s account or card, depending on the issuing entity.

Defective products:

The User has the right to a refund of the price of defective products, as well as shipping and return costs, when the delivered product is defective or does not match the order.

In such cases, the return may be carried out under the same process as above or by contacting BEATERS at the email or phone number provided on the Website. If the return involves a defective product or an incorrect product, BEATERS will cover the return shipping costs, provided the return is made from the same country of delivery.

10. PRODUCT WARRANTY

Products are covered by the legal warranty for lack of conformity revealed within 2 years of delivery, in accordance with applicable regulations. The User must notify BEATERS of such non-conformity within 2 months of becoming aware of it.

The warranty offered corresponds to that established by Royal Legislative Decree 1/2007 of November 16 for the protection of consumers and users.

The warranty does not cover deficiencies due to negligence, accidents, improper use, handling, or use not intended for the product. Products modified or repaired by the User are excluded from the warranty.

11. LIABILITY AND DISCLAIMER

Without prejudice to applicable law and regulations, BEATERS’ liability regarding products purchased through the Website is limited to the purchase price of said products.

BEATERS will not assume liability for, among others:

The use of Website materials by the User in violation of intellectual or industrial property rights of BEATERS or third parties.

Damages caused to Users as a result of normal or abnormal operation of search tools, content organization, access, or errors related to technical elements of the Website.

Content of external websites accessible via links on the Website.

Acts or omissions of third parties, regardless of their contractual relationship with BEATERS.

Access of minors (under 16) to Website content; responsibility lies with parents/guardians to supervise and prevent unauthorized access or data submission.

Errors and delays in Website access, issues with order confirmation due to Internet failures, unforeseen circumstances, force majeure, or other contingencies beyond BEATERS’ control.

Failures in communication, deletion, incomplete transmission, or operational disruptions.

Errors or damage caused to the Website due to improper or malicious use by the User.

Non-functionality of or problems with the email address provided by the User for order confirmation.

BEATERS undertakes to resolve issues that may arise and to provide the User with the necessary assistance for quick and satisfactory solutions.

12. PERSONAL DATA

To purchase BEATERS items, Clients must provide personal data that must be truthful, accurate, up-to-date, and complete. These data will be processed by BEATERS for the purposes and duration described in the Privacy Policy.

13. PARTIAL INVALIDITY

If any of these general conditions are declared null, invalid, or unenforceable, the remaining provisions shall remain valid and binding between the parties.

Waiver by either party to demand compliance with a specific condition at a given time shall not constitute a general waiver of compliance with other conditions, nor create any acquired rights for the other party.

14. NOTIFICATIONS

Some communications to the Client will be made in writing and electronically via the Website. By using this Website, the Client agrees to electronic communications. For contractual purposes, the Client consents to the use of this electronic communication medium and acknowledges that all contracts, notices, information, and other communications provided electronically comply with the legal requirement of being in writing.

Notifications shall be deemed received when posted on the Website, 24 hours after an email has been sent, or three (3) business days after mailing by post.

16. GOVERNING LAW AND JURISDICTION

These Conditions are governed by Spanish law. For the resolution of any dispute arising from the performance or interpretation of this contract, the parties submit to the Courts and Tribunals of the city of Barcelona. If contracting as a consumer, nothing in this clause affects the rights granted to you under applicable legislation.
